Does my project require an EIA under the Environmental Quality Act?

The Environmental Quality Act 1974 and its prescribed activities order set out the categories of project that require a detailed or preliminary EIA before proceeding. The list includes certain land development, industrial, infrastructure, and resource extraction activities. We can review your project scope against the current prescribed activities list and advise whether an EIA is required, and if so, what type.

What does legal support during the EIA process involve?

Our role complements that of your environmental consultant. We advise on the legal framework governing the DOE submission, assist in preparing responses to objections raised during public display periods, and help structure your compliance plan once conditions of approval are issued. If an application is rejected or conditionally approved in a way that is difficult to manage, we can advise on the appeal process.

My business has received a compounding notice from the DOE. What should I do?

A compounding notice is a formal enforcement action and should be addressed promptly. Do not ignore or delay your response. We can review the notice, assess the underlying factual and legal position, and advise on the most constructive course — whether that involves negotiation with the DOE, payment of the compounded sum, or challenge through the appropriate channel. Early engagement with a solicitor gives you the most options.

How long does an environmental compliance audit typically take?

The scope and duration depend on your operations, the number of applicable regulations, and the volume of existing documentation to review. A focused audit for a single-site manufacturer might be completed within two to four weeks. Larger or multi-site operations generally require more time. We will discuss the scope and provide a realistic timeline at the outset of any engagement.

Are company directors personally liable for environmental breaches by their business?

Under the Environmental Quality Act and related legislation, personal liability can attach to directors or officers of a company where an offence is committed with their knowledge, consent, or neglect.
