Case Study 01 · EIA Appeal

Industrial Development EIA Conditional Approval — Selangor

Challenge

A manufacturing client received a conditional EIA approval containing fourteen conditions, several of which were technically difficult to comply with on the proposed project timeline. One condition required modification to site infrastructure not envisaged in the original project plan, at significant cost.

Our Approach

We reviewed each condition against the EIA report submitted and the DOE's stated concerns during public display. We identified that three conditions were inconsistent with representations made by the DOE during the review period, and prepared a formal written response requesting reconsideration supported by technical documentation.

Outcome

The DOE agreed to revise two of the three contested conditions, removing the infrastructure modification requirement and extending the compliance timeline on a third. The client was able to proceed with the project as designed within an acceptable regulatory framework.

Scheduled Waste Compounding Notice — Klang Valley

Challenge

An industrial operator received a compounding notice for scheduled waste disposal irregularities identified during a DOE inspection. The company's waste records were incomplete, making it difficult to demonstrate that disposal had been carried out through licensed contractors throughout the relevant period.

Our Approach

We conducted an urgent review of available records and worked with the client to reconstruct disposal history from contractor invoices, waybills, and internal production records. A written response to the DOE was prepared acknowledging the record-keeping shortfall while demonstrating that licensed disposal had in fact occurred. We also submitted a remediation plan addressing the record management issue.

Outcome

The DOE accepted the compounding notice response and did not pursue prosecution. The compounding sum was reduced by approximately 30% in recognition of the remediation commitments made. The client implemented an improved waste tracking system as part of the agreed remediation plan.
